These Terms and Conditions ('Terms') govern your use of the Shadey Cosmetics website (shadey.co.nz) and your purchase of products from us. By accessing this website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.
1. ABOUT SHADEY COSMETICS

2. ORDERS & CONTRACT
By placing an order, you make an offer to purchase products subject to these Terms. An order confirmation email is an acknowledgement of receipt of your order, not an acceptance. A binding contract is formed when we dispatch your order and send a dispatch confirmation.
We reserve the right to refuse or cancel any order at our sole discretion, including where a product is listed at an incorrect price due to a typographical error. In such cases, we will provide a full refund.
3. PRICING
All prices are displayed in New Zealand Dollars (NZD) unless you have selected Australian Dollars (AUD). Prices are inclusive of GST where applicable. We reserve the right to change prices at any time without notice. The price charged will be the price displayed at the time your order was placed.
4. PRODUCT DESCRIPTIONS & COLOURS
We make every effort to accurately display our products, including colours and shades. However, the colours you see may vary depending on your screen settings and device display. Shadey Cosmetics cannot guarantee that your device's display of any colour will accurately reflect the physical product. Variation in product shade from screen display does not constitute a fault or grounds for return under our change-of-mind policy.
5. USE OF PRODUCTS
Our products are intended for cosmetic use only, applied to the lips and brows as directed. You agree to use our products only as directed on the packaging and on our website. Shadey Cosmetics is not responsible for any harm arising from misuse of our products, use on broken or irritated skin, use by individuals with known cosmetic allergies without prior patch testing, or use in a manner inconsistent with the provided instructions.
A patch test is strongly recommended before first use. Discontinue use if irritation occurs and seek medical advice.
6. INTELLECTUAL PROPERTY
All content on this website including images, text, graphics, logos, and branding is the property of Shadey Cosmetics and is protected by New Zealand and international intellectual property laws. You may not reproduce, distribute, or use any content from this site without our prior written consent.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Shadey Cosmetics' total liability to you for any claim arising out of or in connection with your use of our website or products is limited to the price you paid for the product in question. We are not liable for any indirect, incidental, special, or consequential loss or damage.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
